Practitioner Tool
For use by attorneys and CPAs preparing client returns. Not a consumer tax filing tool. Outputs are estimates only and do not substitute for the practitioner’s independent judgment.
From 1099-MISC Box 2 / Schedule E
Operator-charged gathering, treating, marketing
State tax already netted on royalty checks
DoD FMV (§ 1014 step-up) less prior depletion
Reserves estimate (Mcfe / BOE)
Units produced in this tax year
All taxable income excluding this royalty
Depletion (§ 611, § 613A)
Cost depletion exceeds percentage — using cost. Worth re-checking next year as basis is reduced and percentage may overtake.
Federal tax (estimate on incremental royalty)
Limitations. Estimator covers federal ordinary-income tax on the incremental royalty plus NIIT and IRMAA flagging. State income tax, AMT (full computation), self-employment tax (only relevant to working interests), and full-return interactions (QBI, itemized deductions, capital-gain stacking) are out of scope. Use as a directional check, not a return-preparation substitute.
Authority. IRC § 611 (cost depletion); § 613A (percentage depletion for oil & gas, 15% rate, 1,000 BOE/day independent-producer cap, 65%-of-taxable-income limit); § 1014 (basis step-up at death); § 1411 (NIIT); § 57(a)(1) (AMT preference); 42 U.S.C. § 1395r(i) (IRMAA). Brackets reflect 2025 federal ordinary-income tables; verify annually as IRS adjusts.
